("we", "our", "us"), including EasyPMS365 and related modules such as PMS, POS, Booking Engine, and Channel Manager (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing the Services, or using any part of our platform, you agree to comply with these Terms. If you do not agree, you must stop using the Services immediately.

2. Eligibility

3. Account Registration & Security

• You must maintain the confidentiality of your login credentials.
• You are solely responsible for all activity under your account.

You agree not to misuse the Services. This includes, but is not limited to:

• Attempting unauthorized access to the system or other user accounts.
• Using the Services for fraudulent, illegal, or harmful activities.
• Reverse engineering or attempting to extract source code.
• Interfering with service performance or security.

5. Subscription, Billing & Payments

• Services may require paid subscriptions billed monthly or annually.
• All fees are non-refundable unless required by applicable law.
• Late payments may lead to suspension or termination of Services.
• Taxes may apply based on your region.

6. Data Ownership & Usage

• You retain ownership of the data you upload into the system.
• We may process your data to operate, maintain, and improve the Services.
• Backup responsibility lies with the user unless a backup plan is purchased.
• We follow reasonable data protection and security practices.

7. Intellectual Property

All content, software, interfaces, trademarks, and documentation provided by us are the property of Yukai Cloud SaaS Technologies Pvt. Ltd. You may not copy, distribute, or modify any part of the Services without written permission.

8. Third-Party Integrations

Our Services may integrate with third-party tools (payment gateways, OTAs, channel managers). Your use of third-party platforms is governed by their terms, not ours.

9. Service Availability & Updates

• We strive to provide 24/7 uptime, but uninterrupted service is not guaranteed.
• We may modify or discontinue features without prior notice.
• Updates may include security patches, new features, or performance enhancements.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

• Loss of profits, revenue, or business opportunities.
• Loss of data or service interruptions.
• Any indirect, incidental, or consequential damages.

11. Termination

We may suspend or terminate access to the Services if:

• You violate these Terms.
• You fail to make payments.
• We are required to do so by law or security concerns.

12. Refund Policy

Subscription payments are non-refundable. Pro-rated refunds or credits may be provided only in exceptional cases at our discretion.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in courts located in [Derabassi / Mohali].

14. Modifications to Terms

We may update these Terms at any time. Continued use of the Services after changes indicates acceptance of the updated Terms.
